Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"I) Issue an order or direction upon the revenue Court of Naib Tehsildar Mardah, Tahsil Kasimabad, District Ghazipur (respondent no.2) for expediting the Mutation Case No.T- 20161429101325 of 2016 in between Lalmuni Vs. Dadhibal pending under Section 33/34 Revenue Code, 2006 (Section 34 L.R. Act now repealed) where during the mutation proceeding respondent nos.3,4,5 has filed their objection against the mutation report dated 20.04.2016 submitted by the Halka Lekhpal, on the basis of a sale deed dated 13.04.2016 (However wrongly given as 13.05.2016) in the objection, owing to the frivolous, unsustainable objection taken, in ordinate delay is being caused by the respondents and the petitioners is being deprived of entry/ endorsement in the revenue records."
The petitioner is aggrieved because a mutation case filed in the year 2016 has not been disposed of finally.
Under the circumstances, this writ petition is disposed of directing the respondent no.2, Naib Tehsildar Mardah, Tahsil Kasimabad, District Ghazipur to endeavour to decide the mutation case of the petitioner, expeditiously, preferably within a period of three months from the date a certified copy of this order is filed before him.
