Heard Sri Surya Bhan Singh, learned counsel for the petitioners, Sri Shivam Yadav, learned counsel for respondent no.2 and the learned standing counsel for the State.
The case of the petitioners is that they are employees of Kanpur Jal Kal Vibhag, Nagar Nigam, Kanpur Nagar and in that capacity, they were allotted quarters but it appears that the Kanpur Development Authority is proceeding to issue eviction notices to the petitioners while on the other hand the Jal Kal Vibhag is deducting the house rent allowances from the petitioners. The petitioners have submitted a representation before the Development Authority which was forwarded to the State Government on 13.5.2020 for their continuance, on the basis of the Government Order dated 15.11.2003 but till date the State Government has not taken any decision.
Learned counsel for the respondents state that no useful purpose would be served by keeping this petition pending, same be disposed of by giving appropriate direction to the respondent/competent authority concerned.
This writ petition is disposed of with the direction to the Competent Authority to decide the pending representation of the petitioenrs which was forwarded to the State Government on 13.5.2020, or a fresh representation, as the case may be, as expeditiously as possible, preferably within 6 weeks from the date of receipt of this order, in accordance with law, by a reasoned / speaking order, under intimation to the petitioner.
