Court No. - 34
Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 8420 of 2021 Applicant :- Lallan Singh Opposite Party :- State of U.P.
Counsel for Applicant :- Arvind Kumar Mishra Counsel for Opposite Party :- G.A.
Hon'ble Yashwant Varma,J.
Heard learned counsel for the applicant, Sri Sanjay Sharma, the learned A.G.A. for the State and perused the record.
The instant application has been moved seeking anticipatory bail in light of the apprehension of the arrest of the applicant in Case Crime No.50 of 2018, under Sections 354B, 452, 147, 323, 504, 506 IPC, Police Station- Bhimpura, District - Ballia.
The Court finds no ground to accord the facility of anticipatory bail to the applicant for the reasons which have been recorded hereinafter.
Firstly, the FIR in question was registered as far as back in 2018. Wholly vague allegations have been made in the petition insofar as an apprehension of arrest is concerned. The Court also bears in mind the order dated 29 May 2018 passed by the Division Bench of this Court in Criminal Misc. Writ Petition No.14100 of 2018 in terms of which the petitioner and others were required to surrender before the concerned court below within 45 days and apply for bail. Admittedly the petitioner did not surrender as per the direction of the Division Bench.
In view of the aforesaid, the petition fails and is dismissed.
