Learned counsel appearing on behalf of petitioner without entering into the merits of the case submitted that the order dated 8.3.2019 passed by the coordinate bench of this Court in writ petition no. 6741 (SS) of 2019 the District Magistrate, Sultanpur decided the representation of the petitioner without considering the Government Order dated 13.05.2015, which is appended as Annexure-10 to the writ petition. He has made limited prayer to the court that District Magistrate, Sultanpur may be directed to decide the representation as fresh in the light of the g.O. dated 13.05.2015.
Learned Standing Counsel appearing on behalf of the State-opposite parties submitted that the petitioner has failed to make out a case for issuance of a writ or direction in the nature of certiorari for quashing of the order dated 7.6.2019 but since petitioner has not entered into the merits of the case and only made prayer for deciding the representation in the light of the G.O. dated 13.05.2015 ignoring the order dated 7.6.2019. He fairly conceded that he has no objection in case direction is issued to decide his representation.
In view of above facts and circumstances and without entering into the merits of the case, the petitioner is directed to make a fresh representation within seven days from today to the District Magistrate, Sultanpur, and in case such a representation is made, the District Magistrate, Sultanpur is directed to consider and decide the said representation of the petitioner ignoring the order dated 7.6.2019 (Annexure-1 to the writ petition), in accordance with law, considering the contents of the G.O. dated 13.05.2015, within a period of three months from the date a certified copy of this order along with copy of the representation is produced before him.
The writ petition is disposed of accordingly.
