1. Heard learned counsel for the applicant, Sri Narendra Kumar Tiwary, learned counsel for the respondent no.2 and learned A.G.A. for the State.
2. This anticipatory bail application has been filed on behalf of the applicant Lalji Yadav, seeking anticipatory bail in Case Crime No. 1395 of 2020, under Sections- 135 of Indian Electricity (Amendment) Act, 2003, Police Station - Anti Power Theft Ghazipur, District - Ghazipur during pendency of trial.
3. In view of the direct fact allegation has been made against the applicant with respect to theft of electricity against connection granted for agricultural purpose, the discretion claimed for grant of anticipatory bail is declined.
4. Accordingly, the present anticipatory bail application is rejected, leaving it open to the applicant to apply for regular bail, which application when filed may be considered on its own merit as expeditiously as possible, without being prejudiced by any observation made in this order.
