Heard Mr. Surendra Kumar Chaubey, learned counsel for the appellant and Mr. Tariq Maqbool Khan, learned counsel for respondent no.5.
The special appeal is directed against the order dated 15.5.2018, whereby the appellant's writ petition assailing the validity of the order dated 23.4.2018 passed by the Sub Divisional Magistrate, canceling the auction proceedings, has been disposed of. The highest bidder had quoted Rs.30 lacs for allotment of fishery rights of pond in question, whereas the appellant had quoted Rs.2 lacs. It has come on record that the highest bidder had also deposited 10% of the amount and since he failed to deposit the remaining amount, the bid has been cancelled and directions are issued to hold fresh auction proceedings.
We do not find any error as such in the order, warranting interference by this Court in intra court appeal. The special appeal is dismissed.
