The grievance of the petitioner is that in spite of the orders passed by the Consolidation Officer, the private respondents are raising construction.
Ordinarily, the Courts do not issue any direction in property matters but in the present case we find that the Consolidation Officer has passed orders directing the Station House Officer, Jhunsi, Allahabad for compliance of the stay order.
Our attention has been drawn to the interim order passed by the Consolidation Officer dated 17.11.2018 wherein the Consolidation Officer has issued a positive direction against the respondents.
Learned Standing Counsel has accepted notices on behalf of respondent nos. 1, 2 & 3. We are not issuing notice to the private respondent nos. 4 to 9 as their interest is protected by this order. With the consent of learned counsel appearing for the parties, the writ petition is taken on board and is being decided finally at this stage in terms of the Rules of the Court.
Having due regard to the orders of the Consolidation Officer, we direct the Station House Officer, Jhunsi, Allahabad to take appropriate decision in accordance with law after hearing respondent nos. 4 to 9. We make it clear that we have not expressed our opinion on the merits of the case, the authority concerned shall act in accordance with law.
The writ petition is, accordingly, disposed of. No order as to costs.
