Let an affidavit be filed by the Registrar General indicating the reasons, on which despite the recommendation of the Committee of Hon'ble Judges referred to at page 42 of the writ petition that Law Graduation be an essential qualification for appointment as Joint Registrar, it has been decided to relax the said requirement under the amendment effected to Rule 20 sub rule (d) of the Allahabad High Court Officers and Staff (Conditions of Service and Conduct ) (Amendment ) Rules, 2013 and how the High Court is to judge whether the Deputy Registrars, who are not Law Graduate after undergoing training at JTRI, Lucknow for a period of three months have infact, acquired knowledge of law for effecting discharge of duties of the post of Joint Registrar.What are the parameters fixed by the High Court to decide that an incumbent who does not have a degree of law has required the knowledge of law for effective discharge of the duties of Joint Registrar by merely undergoing three months' training at JTRI.
We may only record that Law graduation was an essential qualification for appointment on the post of Joint Registrar, which was to be filled on merit only at the time the rules were framed. The criteria has since been diluted time again and now practically the knowledge of law itself has been made a casualty.
We have been informed that all such Deputy Registrars, who had undergone the training at JTRI have not been found suitable for promotion by the Committee of Hon'ble Judges. The recommendation of the Judges committee shall also be brought on record by the next date.
The matter shall be listed on 5.2.2014 at the top of the list.
