THIS CRIMINAL PETITION COMING ON FOR ADMISSION, THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Petitioner No.1-Smt.Lalitha, petitioner No.2- Sri.Ramachandra Reddy, petitioner No.3-Smt.Alumelamma and their counsel and respondent No.2-Smt.Alumelu, are present. Learned Additional State Public Prosecutor for respondent No.1 is also present. Respondent No.2 is identified by petitioner No.1 who is the daughter-in-law of respondent No.2.
2. Parties have filed a Joint Affidavit duty sworn to by the petitioners and respondent No.2 wherein respondent No.2 has withdrawn all the allegations made against the petitioners and has requested to quash the proceedings. It is stated that at the instance of elders, relatives and family friends, petitioners and respondent No.2 have sorted out their disputes and have mutually agreed that they shall not interfere with either of the family in future and shall not cause any harm to each other or harass each other. The parties submit that they have voluntarily executed the said affidavit and request the Court to quash the proceedings in terms of the said affidavit.
3. Charge sheet is filed against the petitioners for the offences under Sections 506, 341 and 323 r/w Section 34 of Indian Penal Code.
4. In view of the mutual settlement arrived at between the parties, petition is allowed. The proceedings pending against the petitioners in C.C.No.10990/2013 on the file of V Additional Chief Metropolitan Magistrate, Bengaluru are hereby quashed.
