Shri Shakil Ahmad, Advocate has filed his Vakalatnama along with counter affidavit on behalf of opposite party no.2 in the Court today which is taken on record.
This application u/s 482 Cr.P.C. has been filed seeking the quashing of charge sheet dated 23.06.2016 as well as the entire proceedings arising out of Case Crime No. 109 of 2016 under sections 323, 504, 506 I.P.C., Police Station- Greater NOIDA, District- Gautam Budh Nagar, pending in the Court of A.C.J.M., IIIrd, Gautam Budh Nagar.
Heard applicants' counsel, learned counsel for opposite party no.2 and learned AGA.
Entire record has been perused.
This application has been filed seeking quashing of charge- sheet but the documents that have been submitted are wholly incomplete. The applicant seeks quashing on the basis of an affidavit filed on behalf of opposite party no.2 while perusal of the record shows that there were other injured persons also and in such circumstances just because of some affidavit filed by opposite party no.2 the proceedings cannot be quashed. The perusal of the first information report prima facie discloses commission of offences and there is no good ground to quash the impugned proceedings.
The application therefore stands dismissed.
