Vakalatnama on behalf of respondent no. 7 has been filed Sri A.K. Malviya and Sri Rajesh Pachori. The same is taken on record.
Heard learned counsel for the petitioner, learned Standing Counsel appearing for the State respondents as well as Sri A.K. Malviya and Sri Rajesh Pachori, learned counsel appearing for the respondent no. 7.
Present petition has been filed seeking direction to the respondent nos. 1 to 4 to conduct proper inquiry for cancellation of license of fair price shop of Smt. Vimlesh.
On 15.11.2019 following order was passed:-
"Learned counsel for the petitioner states that the complaint which the petitioner had filed on 17.06.2019 is not being considered simply because the criminal case against the dealer had resulted in the filing of a final report.
Learned Standing Counsel to take instructions. Place this case on 28.11.2019 as fresh." Admittedly, the petitioner is a complainant.
As per instruction dated 22.11.2019 filed today fulfledged inquiry was conducted. Thereafter, the license of the respondent no. 7 was restored after the matter was remanded back by the Commissioner.
Clearly the inquiry has already been conducted and consequential orders have also been passed.
In such view of the matter, I do not find any good ground to entertain present petition.
Present petition is accordingly dismissed.
