Counsel for the petitioner submitted that the petitioner has moved an application dated 18.03.2021 before the District Magistrate making complaint against the President of the Nagar Panchayat Sahpau by invoking provision of Section 48 of U.P. Municipalities Act, 1916.
On pointed query made by the Court regarding procedure for submitting the complaint against an elected President, learned counsel for the petitioner could not answer. A perusal of the provision in Section 48 of U.P. Municipalities Act, 1916 shows that the action can only be taken by the State Government.
The present petition is, thus, found misconceived and the same is accordingly, dismissed.
