Counter affidavit filed by learned AGA today, is taken on record.
Heard learned counsel for the applicant, learned AGA and perused the record.
By means of this application, the applicant who is involved in case crime no. 639 of 2017, under Sections 498A, 304B IPC and 3/4 D.P. Act, P.S. Ajeetmal, District- Auraiya, is seeking enlargement on bail during the trial.
Submission made by the counsel for the applicant that the applicant is the husband of the deceased. It is further submitted that the applicant has got married with the deceased on 13.05.2017 and the victim died under the unnatural circumstance (after setting her ablaze within 5 months of the marriage). It is further submitted that there is a legal presumption against the applicant.
Under the circumstances, I do not find any good reason to exercise my discretion in favour of the accused applicant. Thus, the bail application stands rejected.
It is expected from the learned trial court to gear up the trial and made necessary endeavour to conclude the same within a period of one year, provided the applicant would render all necessary co- operation in early conclusion of the trial.
Office is directed to communicate the copy of this order to concern court for the necessary compliance within 15 days from the production of certified copy of this order.
