Petitioner alleges that he was appointed as a Class-IV employee and such engagement was regularised vide order dated 21.8.2000 on the basis of the recommendation made by the Selection Committee. This order, however, was cancelled by the Commissioner vide order dated 22.6.2001. The order of the Commissioner has been challenged in the present writ petition on the ground that no notice and opportunity was afforded to the petitioner and that no justification otherwise exists for such order to be passed. It appears that the writ petition was entertained and the respondents were directed to examine petitioner's grievance afresh.
Sri Govind Krishna, learned counsel appearing on behalf of respondent nos. 3 & 4 states that pursuant to the order dated 5.7.2001 passed in Writ Petition No.24169 of 2001, which arose out of similar circumstances, the respondents have proceeded to consider petitioner's claim for regularisation. A fresh order is stated to have been passed by the Nagar Palika Parishad, Aligarh on 30.12.2003, confirming the services of the petitioner substantively. It is stated that pursuant to the order dated 30.12.2003, petitioner has been continuing in service and has is receiving salary and other benefits.
In that view of the matter, no further grievance survives. This petition is disposed of, while recording the statement of Sri Govind Krishna that the services of petitioner have been confirmed vide order dated 30.12.2003, and that the petitioner is continuously working ever since then.
Writ petition stands disposed off.
