Petitioner is working as Assistant Teacher in Sanskrit in Sunder Singh Inter College, Ramgarh, Harchandpur, Auraiya and has moved an application for his transfer to S. A. V. Inter College, Saini, Sirathu, Kaushambi on 29.6.2018, as his wife is also an Assistant Teacher posted at Kaushambi. It is alleged that application has already been made to the Additional Director, who is the competent authority in terms of regulations to consider such grievance, but no decision as yet been taken. Hence, petitioner is before this Court.
Learned Standing Counsel points out that a Govt. Order has been issued on 10.9.2018 stating that such transfers be considered only in the annual transfer chain and not otherwise.
Be that as it may, once the issue relating to petitioner's transfer has been raised before the competent authority i.e. respondent no.2, it would be appropriate to direct respondent no.2 to take appropriate decision in respect of petitioner's grievance, in accordance with law, within a period of three months from the date of presentation of certified copy of this order.
Subject to the aforesaid observations, this writ petition stands disposed off.
