Heard learned counsel for the petitioner and Sri Bhupendra Kumar Tripathi, learned counsel appearing for the Gaon Sabha.
Present petition has been filed with following prayer:-
"(i) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.2, Sub-Divisional Officer, Tehsil- Budhanpur, District- Azamgarh to decide the case no. 00776 of 2019 (Old case no. 557 of 2012) computerized case no. T201915060600776 (Lalchand vs. Radheshyam and others) under Section 116 of U.P Revenue Code, 2006, forthwith, pending since 04.12.2012, expeditiously within stipulated period.
(ii) Issue any other writ, order or direction, which this Hon'ble Court may deem fit and proper in the circumstances of the case.
(iii) Award the cost of the petition in favour of the petitioner."
I have perused the order-sheet annexed as annexure no. 6 to the writ petition. According to which, on all dates advocates were abstaining from the judicial work, therefore, I do not find any good ground to entertain the present petition.
Accordingly, present petition stands dismissed.
After passing of the order, learned counsel for the petitioner submitted that, in case, the petitioner and other concerned parties are present before the authority concerned, the authority concerned may be directed to consider and decide the matter strictly in accordance with law.
In such view of the matter, it is provided that, in case, the petitioner and other concerned parties are present before the authority concerned, the authority concerned shall proceed to consider and decide the matter strictly in accordance with law.
With the aforesaid observation, present petition stands dismissed.
