Heard Sri Vivek Kumar Singh, for the petitioner; learned A.G.A. for the respondents 1, 2 and 3; and Sri Lalta Prasad for the respondent no.4; and perused the record.
The petitioner no.1 (Lalita) and the respondent no.4 (Asharfi Lal) are also present in Court and they have been identified by their respective counsels.
This petition has been filed for quashing of the first information report dated 02.12.2019 registered as Case Crime No.429 of 2019, under Sections 366, 120-B IPC, P.S. Machhlishahar, District Jaunpur.
The allegations in the impugned first information report, which has been lodged by the respondent no.4, is that his daughter Lalita, aged about 20 years, has been enticed away by Praveen Kumar Gautam (petitioner no.2) in conspiracy with other accused.
Lalita (the victim) and Prveen Kumar Gautam along with other accused have jointly filed this petition by claiming that Lalita and Praveen Kumar Gautam are admittedly adult and they have voluntarily married each other and no offence has been committed.
Lalita, who has appeared before us, has stated in front of the respondent no.4 that she has voluntarily married Praveen Kumar Gautam and that no force or fraud has been used upon her.
The respondent no.4, who has also appeared before us, does not dispute that Lalita has attained the age of majority.
In view of the above, the impugned first information report is liable to be quashed and is hereby quashed. The petition stands allowed.
