The regular Bench for service matters is of Hon. Mr. Justice Krishna Murari. In similar matters relating to the transfer of the Police Constables from the Civil Police to G.R.P. in Writ Petition No. 45628 of 2012 and other connected writ petitions, the following order has been passed on 17.9.2012.
"In so far as the prima-facie case is concerned, the issue is pending adjudication by a larger Bench. In so far as other two factors are concerned by refusal of an interim order, no irreparable loss would be caused to the petitioners as their status, pay, allowances and seniority etc. remain unaffected. Balance of convenience is also not in favour of the petitioners as the Government Railway Police, which is entrusted with the duty to check crime in railways, cannot function effectively without sufficient personnel and the same may cause great inconvenience not only to the State but also to the public at large.
All these factors have not been taken into consideration while passing the interim orders in identical matter with which the petitioners are claiming parity.
In view of above facts and circumstances, no case for grant of interim order is made out. Accordingly, the application for interim stay stands rejected.
However, the joining of the petitioners in Government Railway Police shall be subject to final outcome of the writ petitions.
List after decision by the larger Bench. In the meantime, the parties may exchange the pleadings."
Learned counsel for the petitioners as well as learned Standing Counsel state that similar order be passed in the present writ petition also.
In view of the above statements, the order, referred hereinabove, may be treated as the order passed in the present writ petition.
Connect it with Writ Petition No. 45628 of 2012. List before appropriate Bench. It shall not be treated as tied up or part heard to this Bench.
