Court No. - 34
Case :- WRIT - C No. - 26915 of 2019 Petitioner :- Lal Singh Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Ashok Kumar Upadhyay,Rajesh Tripathi Counsel for Respondent :- C.S.C.,Saurabh Tiwari
Hon'ble Sudhir Agarwal,J. Hon'ble Rajeev Misra,J.
1. Heard Sri Rajesh Tripathi, learned counsel for petitioner, learned Standing Counsel for State and Sri Saurabh Tiwari, learned counsel for respondent 6.
2. This is a thoroughly ill advised and misconceived writ petition. Allegation of petitioner is that respondents are demanding bribe from him and his brother, but admittedly no criminal proceeding has been initiated by petitioner, though he could have filed a first information report in this regard.
3. We also find that a similar petition was earlier filed by petitioner's father, Jai Charan Singh i.e. Writ Petition No. 25754 of 2019 and the same was dismissed by this Court vide judgment dated 6.8.2019 as not maintainable and for the same cause of action this petition has been filed by his son. It is nothing but gross abuse of process of law. In view thereof, writ petition is dismissed with cost of Rs. 20,000/-.
