Learned counsel for the applicant states that proceeding which is challenged by the applicant in the present application pertains to the year 2003. Learned counsel for the applicant states that in the cases on the basis of which Gangster Act has been clamped upon him, the applicant has been acquitted, therefore, the proceedings are liable to be quashed.
I have heard learned counsel for the applicant and perused the record.
I find that the evidence of Investigating Officer is yet to be recorded in the trial court, as such, at this stage no interference is warranted in the exercise of power u/s 482 Cr.P.C.
The petition lacks merit and is, accordingly, dismissed.
In view of the fact that the trial pending since 2003, the trial court is directed to expedited the trial and conclude the same within a period of three months from the date of production of a certified copy of this order.
Office is directed to communicate the copy of this order within 72 hours to the court concerned.
I am of the opinion that mere acquittal in the case on the basis of which Gangster Act has been clamped per se would not be a ground to quash the entire proceedings of the case.
