.....Respondent/ Complainant Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to grant anticipatory bail to the petitioners in the event of their arrest in connection with F.I.R. No. 113 of 2013, dated 10-09-2013 on the file of the Kodangal Police Station, Mahabubnagar District.
The petition coming on for hearing, upon perusing the petition and the Memo of grounds filed herein, and upon hearing the arguments of SRI SRI JALAKAM SAMPATH KUMAR Advocate for the Petitioner and of the Public Prosecutor, for the Respondent, the Court made the following.
ORDER:-
The petitioners are A.2 to A.5. They seek for grant of anticipatory bail. They allegedly committed an offence under Section 306 IPC. The deceased is the son-in-law of petitioners 1 & 2. The petitioners 3 & 4 are the sons of petitioners 1 & 2. A.1 is the daughter of petitioners 1 & 2. She had already obtained anticipatory bail.
The case of the prosecution is that the deceased committed suicide as he could not withstand harassment from the petitioners and A.1.
In view of the nature of the offence alleged against the petitioners and in view of the fact that A.1 had already been enlarged on bail, I consider it appropriate to enlarge the petitioners on anticipatory bail.
Consequently, the Criminal Petition is allowed.
The petitioners shall surrender before the Judicial First Class Magistrate, Kodangal, Mahaboobnagar District, within two weeks from today. On such surrender, the learned Magistrate shall enlarge the petitioners on bail on a personal bond of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each in a like sum to his/her satisfaction.
