Heard Sri Narendra Shanker, learned counsel for the petitioner and Sri J.K. Upadhyay, learned A.G.A. for the respondent Nos. 1 to 4.
According to the petitioner, deliberately investigation is being given to an officer of the choice of the complainant.
In this petition, the petitioner has prayed for issuance of a suitable direction for fair and impartial investigation.
State counsel submits that it is within the domain of the State to get the matter investigated by a responsible officer and the petitioner cannot choose the investigating officer. He further submits that the apprehension shown by the petitioner regarding investigation is premature and the investigation would be done in an impartial manner.
We do not find any substance in the writ petition. The same is accordingly dismissed. However, it is expected from the State authorities to complete the investigation fairly and impartially in accordance with law.
