The petitioner's Writ Petition No.5858 (SS) of 2018 was finally allowed by the Writ Court vide judgement and order dated 16.3.2018 directing the respondent no.3 i.e. Director, Administration and Monitoring, Narendra Dev University of Agriculture and Technology, Kumarganj, Faizabad (Now Ayodhya) to pay the petitioner's salary from 1.10.1996 to 9.10.1996 (9 days) and 9.9.1997 to 23.9.1997 (15 days) within a period of three months from the date of production of a certified copy of the order. It was further directed that before making payment of the aforesaid salary, the requisite exercise for verifying the attendance for that period would carried out by the respondent concerned.
Sri Satyanshu Ojha, who has filed Vakalatnama on behalf of the University, has tendered a copy of the order dated 31.7.2019 passed by the University, whereby the petitioner has been sanctioned the earned leave for this period as it is difficult to verify whether the petitioner attended the University for the said period or not. The earned leave is to be paid at the time of retirement and, therefore, no payment can be made for earned leave at this stage.
In view of the aforesaid decision dated 31.7.2019 taken in the case of the petitioner, nothing survives in the present contempt petition, which is hereby dismissed as having become infructuous.
Contempt notice stands discharged.
