1. Heard learned counsel for applicant and learned A.G.A. for State.
2. This is a bail application moved by accused-applicant for enlarging him on bail in Case Crime No. 468 of 2016, under Sections 498A, 304B IPC and 3/4 Dowry Prohibition Act, Police Station Rudrapur, District Deoria.
3. It is contended that First Information Report is highly belated and it is a case of suicide. However, I find no force in submission. Within three years of marriage incident has taken place and cause of death is ante mortem hanging as stated in post mortem report. Death has taken place at applicant's residence and First Information Report was not lodged by applicant or his family members. In fact even police did not lodge report on the complaint made by father of deceased and he was compelled to move application under Section 156(3) Cr.P.C. thereafter First Information Report was registered. Therefore, even delay in First Information Report stand explained. Looking to entire facts and circumstances, I do not find it a fit case for grant of bail.
4. Application is accordingly dismissed.
