The grievance of the petitioners is that their lands have been acquired under the National Highways Act (hereinafter referred to as the 'Act') but the Competent Authority has not paid compensation to the petitioners because of the objections raised by the respondent Nos. 4 to 6.
It is for the petitioners, if so advised, to file an appropriate application before the Competent Authority, under Section 3H(3) of the Act.
Learned Standing Counsel and learned counsel appearing for the National Highways Authority state that in case such an application is filed, a decision shall be taken expeditiously after hearing the parties concerned.
The writ petition is, accordingly, disposed of with a direction that in the event the petitioners file an application before the Competent Authority, a decision shall be taken after hearing the parties concerned expeditiously and preferably within a period of four months from the date a certified copy of the order along with the application is filed.
It is made clear that the Court has not adjudicated on the merits of the case and it would be for the Competent Authority to decide the application in accordance with law.
