Sri S.K.Singh, learned counsel for the petitioner who is defendant in suit No234 of 2015 (Lalti Devi and others Vs Lalji and others) pending in the court of Civil Judge City (JD) Chandauli, submits that in the suit temporary injunction was granted to the plaintiffs against the defendant. The defendant has filed objection 7 Ga (2) which is lingering since 21.3.2017 and has not been decided till date and the plaintiffs are seeking adjournments on one pretext or the other.
Considered the submissions made across the bar and perused the record.
In the circumstances of the case, in the light of the decision of the Apex Court in M/S Shiv Cotex Vs Tirgun Auto Plast P Ltd and others 2011 (89) ALR 232, the learned trial court is directed to decide the Application l7 Ga 2 expeditiously preferably within six weeks. It may be noted that no unnecessary adjournments shall be granted in the case.
