Heard learned counsel for the petitioner, Sri S.K.Kakkar, Advocate, for respondent no.3 Sri Ashok Kumar Pandey, learned counsel for respondent no.4 and learned Standing Counsel for State Authorities.
By means of this writ petition the petitioner has come to this Court seeking the direction that the interest amount, upon the loan taken by the petitioner, be paid by respondent no.4.
The petitioner had taken a loan of Rs.2,85,000/- for the purpose of manufacturing jewelry under the Chief Minister Gramin Rojgar Yojna. One of the clauses in the agreement is that the petitioner will pay principal amount to the respondent no.3-Bank and thereafter the Bank will give statement of accounts in prescribed Proforma to the Khadi Gramodyog Board and thereafter payment of interest would be made.
Sri Ashok Kumar Pandey, learned counsel appearing for respondent no.4 submits that since statement of accounts in prescribed proforma is not being submitted to respondent no.4, therefore, no payment is being made.
Counsel for the petitioner submits that on account of non-payment of interest by respondent no.4, recovery certificate has been issued against the petitioner.
The writ petition is disposed of with the direction to the respondent no.3 to comply with the conditions of Chief Minister Gramin Rojgar Yojna and submit statement of account in prescribed proforma to the respondent no.4. In case, statement of accounts in prescribed proforma is submitted to the respondent no.4, payment of interest on the loan advanced to the petitioner be made in accordance with the terms under the aforesaid Scheme. The petitioner may approach the Bank for furnishing the statement in prescribed proforma to the respondent no.4.
For a period of two months, pursuant to the recovery certificate dated 13.5.2018, no coercive action shall be taken against the petitioner.
