It is stated that facts of the present case are similar to one occurred in Writ Petition No.2868 of 2018 (Bibha Singh Kushwaha and Others Vs. State of U.P.), decided on 6.2.2018.
Petitioner is Assistant Teacher working in Primary School Bahadur Nagar, Block- Parsendi, District Sitapur, who is seeking transfer from one district to another. Reliance is placed upon the provisions of Rule 8(2)(d) of the Uttar Pradesh Basic Education (Teachers Posting) Rules, 2008. It is stated that in terms of the policy, petitioner has already moved online application, which have not been considered so far. Reliance is also placed upon the judgment of this Court in Bibha Singh Kushwaha (supra).
Considering the above, this writ petition stands disposed of directing the respondent no.2 to examine the petitioner's grievance, as noticed above, keeping in view the observations made in Bibha Singh Kushwaha (supra) and also Rule 8(2)(d) of the Rules of 2008, within a period of two months from the date of presentation of certified copy of this order before respondent no.2.
