Heard the learned counsel for the applicant and the learned AGA and perused the record.
This is an application for a direction to decide the trial of Special Sessions Trial No. 90 of 2016 (State v. Kedar nath and others) arising out of Case Crime No. 679 of 2015, under sections 323, 354-B, 419, 420, 467, 468, 452, 471, 504, 506 IPC and 3(1)(XI) Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, P.S. Jalalpur, District Jaunpur pending in the court of the Additional Sessions Judge, Court No. 4, Jaunpur within a stipulated period.
The matter is pending since the year 2016 and it would not be justifiable to direct the court below to drift apart from earlier filed cases and decide the instant case within a stipulated time, therefore, this Court is not inclined to interfere in the matter at this juncture, therefore, the prayer sought for, is hereby, rejected.
However, keeping in view the facts and circumstances of the case and submissions of the learned counsel for the applicant and the learned A.G.A., the learned trial court is expected to gear up the trial of the aforesaid case and dispose of the same as early as possible, in accordance with law.
With the aforesaid observations the petition under section 482 Cr.PC is disposed of.
