List has been revised. Nobody is present for the petitioner. Sri, Ajit Kumar Singh, lLearned Standing Counsel is present for the respondent.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the order dated 2.11.2017 passed in Writ Petition No.50693 of 2017 (Mohan Lal and others Vs. State of U.P. and Others). The operative portion of the order is reproduced hereinbelow:-
"Considering the facts and circumstances of the case, this writ petition is disposed of with a direction to the respondent No.3 to decide the aforesaid application in accordance with law, expeditiously preferably within three months from the date of presentation of a certified copy of this order, after affording reasonable opportunity of hearing to the parties concerned.
It is made clear that this court has not expressed any opinion on merits of the case."
It is argued by learned Standing Counsel that in compliance of the order of this court, a decision has already been taken on 7.2.2019 by the opposite party, a copy of the said order is appended as annexure 1 to the affidavit of compliance and no cause of action would further survived and prays for dismissal of the present contempt application.
Since the order of the writ court has already been complied with, therefore, no further order is required.
Accordingly, the present contempt application is dismissed.
In case, the applicant is still aggrieved with the decision of the opposite party, he has liberty to challenge the same before appropriate forum.
