The sole prayer made in the instant petition is for issuing direction to the trial court to decide the Restoration Application in Misc. Case No. 53 of 2008/74, arising out of Original Suit No. 198 of 2006 within a stipulated period.
Counsel for the petitioner points out that the plaintiff has already entered appearance and is contesting the proceedings.
Having regard to the facts of the case and the submissions made, the instant petition is disposed of with direction to the trial court to make serious endeavour to decide the application expeditiously, by fixing short dates and without granting unnecessary adjournments to the parties.
