Petitioners are before this Court and their grievance is that they have opened Savings Bank Accounts at Zila Sahakari Bank Limited, Jaunpur and deposited huge amount. Petitioner no. 1 has a balance of Rs.6,72,264.81/- in his account and petitioner no. 2 has a balance of Rs.8,40,387/-. Petitioners are submitting that they are in dire need of the money, but the money in question has not been released and, accordingly, this Court should come to the rescue and reprieve of the petitioners.
On the matter being taken up today, Shri Udai Bhan Singh, Advocate has produced before us copy of communication dated 20.05.2016 issued by the Commissioner and Registrar, Sahkarita, U.P. wherein in reference of payment that has to be made, a full-fledged mechanism has been provided for and it has been contended that as per the directives so issued, in respect of petitioners also, requisite exercise would be undertaken.
Once it has come before us that a scheme in question has been formulated and as per paragraph 3 of the communication dated 20.05.2016, as scheme in question formulates that at the first instance, the account holder would be made payment of 25% of the amount and thereafter remaining 75% would be paid in three equal installments. Consequently, as petitioners have contended that their financial condition is not good, we proceed to pass an order to the concerned Bank to get the verification made of the entire amount in question that has been deposited by the petitioners and then as far as release of first installment in question is concerned, the same be ensured within a period of four weeks from today and on the said score requisite exercise be undertaken and for the balance 75%, requisite exercise be undertaken as per the scheme that has been so formulated, and payment of entire amount be made in instalments within the time period as specified in the Scheme dated 20.5.2016.
With this direction, writ petition is disposed of.
