Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondent.
The instant writ petition is filed to issue a mandamus directing the District Magistrate, Ballia-respondent No.2 to decide the complaint letter dated 20.3.2018.
As jointly agreed by the learned counsel for the parties, the writ petition is disposed of by directing the District Magistrate, Ballia to remove the remaining encroachments which he has mentioned in his personal affidavit, if possible, within a period of one month from the date the certified copy of this order is produced by the petitioner.
It is made clear that before removal of the encroachment, the opportunity of hearing be provided to the concerned parties.
With the aforesaid directions, the writ petition is disposed of.
