Consequent upon the death of petitioners' son, compassionate appointment is offered to petitioners' daughter-in-law i.e. respondent no.4. An agreement was arrived at between the parties so that the aged parents are looked after by the daughter-in-law. It is stated that since the daughter-in-law has been transferred from Gujrat to Aligarh, she has stopped taking careof the aged parents.
It is contended that by virtue of rules framed by the respondents for grant of compassionate appointment, the appointee would have to look after other family members also but she has failed to honour the responsibility. It is also urged that the authorities have not taken any action in the matter.
Learned Standing Counsel has obtained instructions in the matter according to which petitioner has not approached the competent authority and as such, no action could be taken in the matter.
In that view of the matter, this petition stands disposed of by permitting the petitioners to represent their grievance before the respondent no. 2, annexing all materials in support of their claim alongwith copy of this order, within a period of three weeks from today. The concerned authority shall examine such grievance of petitioners and would pass necessary orders after affording an opportunity of hearing to respondent no. 2, expeditiously.
