Heard Mr. Kshitij Tiwari, Advocate, holding brief of Mr. Dhirendra Kumar Srivastava, learned counsel for applicants and learned A.G.A. for State.
This application under section 482 Cr. P. C. has been filed challenging order dated 24.02.2018 passed by Additional Sessions Judge/Special Judge S.C./S.T. Act, Chandauli, in Complaint Case No. 216 of 2017 (Lal Bahadur Vs. Anil Kumar Agrawal and others), under sections 323, 504, 506, 452, 427 IPC and Section 3(1) (10) of S.C./S.T. Act, P.S. Mughalsarai, District Chandauli, whereby aforesaid complaint has been rejected under Section 203 Cr. P. C.
At the very outset, learned A.G.A. has raised a preliminary objection by submitting that order impugned in present application is revisable in terms of Sections 397/401 Cr. P. C. Consequently, present application is not maintainable.
When confronted with above, learned counsel for applicant could not overcome the same.
Consequently, present application fails and is liable to be dismissed on the ground of alternative remedy.
It is, accordingly, dismissed on the ground of alternative remedy.
Certified copy of impugned order may be returned to learned counsel for applicant after obtaining photo copy of the same to be kept on record.
