The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the order dated 29.11.2019 passed in Writ Petition No.38848 of 2019 (Lal Bahadur Singh Vs. Sub Divisional Magistrate and Others).
Today when the mater is taken up, pursuant to the order of this court, Sri. K.R. Singh, learned Additional Chief Standing Counsel filed affidavit of compliance on behalf of opposite party and the same is taken on record.
It is stated in paragraph six of the aforesaid affidavit that in terms of the order of this court, recall application has been decided by the opposite party vide its order dated 05.08.2021 and the order dated 20.06.2018 has been recalled. It is stated in paragraph 7 of the aforesaid affidavit that the order passed in the writ petition has been fully complied with.
In the circumstances, it is argued by Sri. K.R. Singh, learned Additional Chief Standing Counsel that no further cause of action would further survived and prays for dismissal of the present contempt application.
Heard learned counsel for the parties.
Since the order of the writ court has already been complied with, therefore, no further order is required.
Accordingly, the present contempt application is dismissed.
In case, the applicant is still aggrieved with the decision of the opposite party, he has liberty to challenge the same before appropriate forum.
