Petitioner is a member of U.P. Zila Panchayat (Central Transferable Cadre) Service and was working as Junior Engineer at the relevant time.
The Hon'ble Governor by the impugned order has granted permission to prosecute him for the offences under Sections 409, 420, 467, 468, 471, 477-A, 120-B, 34 I.P.C., read with section 13(2), 13(1) (d) of Prevention of Corruption Act, 1988 in exercise of his power under Section 19 of the said Act. The said order has been communicated by the Additional Chief Secretary, Panchayati Raj, Anubhag-2, State of U.P. vide office order dated 03rd January 2018.
After some arguments at length, Sri O.P. Singh Senior Counsel submits that he may be permitted to withdraw the writ petition as any observation may come in way of the petitioner and ultimately affect him adversely.
In view of the prayer made by the counsel, the writ petition is dismissed as withdrawn.
