Heard learned counsel for the petitioner and learned standing counsel for the respondents.
With the consent of the learned counsel for the parties the writ petition is disposed of at the admission stage itself.
The submission of the counsel for the petitioner is that the petitioner Lal Bahadur Prajapati is Assistant Teacher and is posted at Primary School, Pachokhar, Mirzapur. The petitioner's wife Smt. Pushpa Prajapati who is also Assistant Teacher and is presently posted at Unnao.
The contention of the learned counsel for the petitioner is that the wife of the petitioner Smt. Pushpa Prajapati has sought her transfer from Unnao to her in-laws place which is District Jaunpur or at the place where the petitioner is posted namely at Mirzapur. The contention of the petitioner is that neither the parents of petitioner are residing nor in-laws of respondent no.5 (wife of petitioner) resides at Unnao hence the transfer order is bad in law and is also against the Government Order dated 5.2.2018 (Annexure 4 to the writ petition) Having heard learned counsel for the petitioner, the writ petition is disposed of by directing the petitioner to submit a detail representation before the Secretary Basic Shiksha Parishad, Allahabad, respondent no.3 requesting the transfer of his wife Smt. Pushpa Prajapati, respondent no.5 from Unnao to any place which is coveredpermissible under the aforesaid G.O.
The writ petition is disposed of.
