Heard Sri Raj Karan Patel, learned counsel for the petitioners and learned AGA for the State.
In the petition, it has been contended that petitioner No.2 is aged about 24 years and the marriage of petitioner Nos. 1 and 2 was solemnized on 30.5.2010. It has been contended in para 8 of the petition that respondent Nos. 4 to 7 kidnapped the petitioner No.2 but no date, time or period of alleged kidnapping has been given and more over there is no specific averments to the effect that there is no matrimonial dispute and litigation between the petitioners. No proof of age of petitioner No.2 has been filed.
In view of he allegations made in the application, the petitioner No. 2 cannot be considered to be in unlawful custody of respondent Nos. 4 to 7 and there is no sufficient ground to entertain the petition for habeas corpus.
It is, accordingly, dismissed.
