1. Vide order dated 10th August, 2011, this court had granted ad-interim relief staying the execution, operation and implementation of the judgment and decree dated 29th April, 2009 passed in Regular Civil Suit No.10/2008 by the Principal Civil Judge, Ahwa and the judgment and decree dated 7th March, 2011 passed in Regular Civil Appeal No.40/2009 by the learned 2nd Additional District Judge, Navsari, Camp at Ahwa.
2. Heard Mr. Mehul Rathod, learned advocate for the applicant and Mr. Zubin Bharda, learned advocate for the respondent.
3. Having regard to the submissions advanced by the learned advocates for the respective parties, the court is of the view that the interim relief granted earlier deserves to be confirmed and as such, the application is allowed. The ad-interim relief granted vide order dated 10th August, 2011 shall continue till the final disposal of the second appeal. It is, however, clarified that neither of the parties shall take undue advantage of this order. The civil application stands disposed of accordingly. Rule made absolute accordingly.
