At the very outset, learned counsel for the petitioner has pointed out that as per the report of the Stamp Reporter, there appears to be a caveator counsel, namely, Sri Vipin Kumar Singh, but he is a caveator counsel in the petition of co-accused Ram Palat and he is not a caveator counsel in the present case.
Heard Sri R.K.Singh, learned counsel for the petitioner, Sri Prabhash Pandey, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 7.4.2018, registered as case crime No.109 of 2018, under Sections 379, 504, 506, 201, 411 I.P.C., P.S. Kerakat, District Jaunpur. Learned counsel for the petitioner submits that the impugned F.I.R. has been challenged by co-accused person, namely, Ram Palat before this Court in Crl. Misc. Writ Petition No.14578 of 2018 in which an interim protection has been granted to him by this Court vide order dated 31.5.2018, copy of which is annexed at page-34 of the writ petition, hence the petitioner is also entitled for the same relief.
Learned A.G.A. opposed the prayer for quashing but could not dispute the aforesaid fact as argued by learned counsel for the petitioner.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under Section 173(2) Cr.P.C. but she shall co-operate with the investigation of the case.
With the above direction, this petition is finally disposed of.
