... Respondents Prayer : Civil Revision Petition is filed under Article 227 of the Constitution of India, to direct the District Munsiff, Palladam to complete the trial of the case in O.S.No.317 of 2006 within a period of three months or within a period that may be fixed by this Court.
For Petitioners : Mr. K.A.Mariappan O R D E R According to the petitioner, first respondent has filed the suit in O.S.No.317 of 2016 for partition, which is pending before the District Munsif Court, Palladam. Originally, the first respondent filed the suit in O.S.No.66 of 1996 before Sub Court, Tiruppur. Thereafter it was was transferred to the District Munsif Court, Palladam and the same was re numbered as O.S.No.317 of 2006.
2. According to the petitioner, the suit is posted for Trial and evidence of plaintiff side is over. Now, it has been posted for examination of witnesses on defendant side. Since, the matter has been pending for more than 21 years, the petitioner have filed the present Civil Revision Petition before this court for the above said prayer.
3. By considering the above said facts, this Court is inclined to direct the District Munsif Court, Palladam to dispose of the suit in O.S.No.317 of 2006 as expeditiously as possible in accordance with law, preferably within a period of three months from the date of copy of this order.
4. The Civil Revision petition is disposed of with above directions. No costs. Consequently, the connected Miscellaneous petition is closed.
