The petitioners assail the action of the Joint Sub-Registrar, Madhurawada, Visakahapatnam, in not registering their sale transactions on the basis of the letter dated 12.04.2012 issued by the Visakhapatnam Urban Development Authority.

This letter fell for consideration before this court in WP No.23217 of 2012 and by order dated 12.12.2012, this Court held that in the absence of any prohibition in law, the right of the owner to sell his land could not be taken away by the Visakhapatnam Urban Development Authority by the said letter. This Court observed that mere registration of the document would not entail absolution from liability in the event the original owner and his successors in interest are found guilty of any irregularity in the enquiry that was stated to be pending with the Urban Development Authority.
3. In terms of the aforestated order, this writ petition is also disposed of with the same observation. The Joint Sub-Registrar, Madhurawada, Visakhapatnam, is directed to receive the petitioners’ documents for registration and process the same in accordance with law without reference to the letter dated 12.04.2012 issued by the Visakhapatnam Urbana Development Authority. WP MP No.26518 of 2014 shall stand dismissed in consequence. No order as to costs.
