Heard learned counsel for the petitioners.
By means of this petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"1- direct the Civil Judge (S.D.) Gorakhpur to decide the Suit No.236 of 1996 (Lakshmi Kant vs. Uday Bhan Tiwari and another) (New Number 1661/2017) (Lakshmi Kant vs. Ramakant) pending before him within stipulated time bound period."
Perusal of the ordersheet transpires that the evidence of both the parties has to be concluded.
In such above view of the matter, the petition is disposed of with direction that the court below shall conclude the evidence of the petitioner-plaintiff within the six months, the evidence of the defendant shall be concluded within the next six months and the proceedings of the suit thereafter shall be concluded thereafter within next six months, from the date of production of copy of this order.
It is clarified that time frame provided for disposal of the case shall be deemed to be extended in the event concerned District is hit by another surge of pandemic (SARS COV-2/COVID 19) resulting in the suspension of public movement and/or judicial work in the District concerned.
