HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 17093 OF 2010 ORDER:
This Writ Petition was filed challenging the action of the respondents in demanding the petitioner for payment of stamp duty.
This Court by interim order dated 16.07.2010 directed the respondents not to insist upon the payment of stamp duty @ 5% for registration of lease deed pursuant to the demand made by the second respondent subject to the condition that the petitioner pays the deficit stamp duty payable under Article 31(a)(ii) of Schedule I- A of the Indian Stamp Act, 1899.
It is represented by the learned Counsel for the petitioner that pursuant to the interim order of this Court, the petitioner paid the deficit stamp duty and the period of lease was also completed and in view thereof, nothing survives for adjudication in the Writ Petition.
Recording the said submission of the learned Counsel for the petitioner, the Writ Petition is dismissed as having become infructuous. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed. No order as to costs.
