In view of the averments made in paragraph 10 of the counter affidavit, it appears that no cause of action survives in the present writ petition.
No one has appeared on behalf of the petitioner to press this writ petition even in the revised call. Therefore, the writ petition is dismissed, leaving it open to the petitioner to move a recall application within 30 days, if according to him, cause of action is still survives.
