THIS CONTEMPT PETITION COMING ON FOR HEARING BEFORE FRAMING CHARGES THIS DAY, RAVI MALIMATH J., PASSED THE FOLLOWING:
ORDER This contempt petition is filed on the ground that the order dated 01.02.2019 passed by the learned Single Judge of this Court in Writ Petition No.49556 of 2014 has been disobeyed. In terms whereof, the matter was remitted to the respondent-Commissioner, Bengaluru Development Authority to consider the matter afresh within a period of three months.
2. An affidavit is filed by the Commissioner- Bengaluru Development Authority. She has tendered her unconditional apology for the delay in complying with the order of the learned Single Judge within the prescribed time. The reasons are accepted. The delay in complying with the order of the learned Single Judge is condoned. She has also enclosed Annexure-R1, endorsement dated 16.07.2019 issued by the Deputy Director, Bengaluru Development Authority which indicates consideration of the case of the petitioner.
3. In terms of the endorsement dated 16.07.2019, we do not find any ground to proceed further.
The proceeding is dropped.
