Petitioner is the holder of Ext.P1 patta. Petitioner requested the revenue officials to measure and determine boundary of the petitioner's property. Ext.P2 is the application before the Revenue Divisional Officer, Adoor. This application has been forwarded to the Additional Tahsildar, Konni second respondent. But so far no action has been taken.
2. If the second respondent has a case that this is not in requisite form, petitioner shall make an application in requisite form and make necessary fee for the same. Under the Survey and Boundaries Act, petitioner has to make application either in Form 8 or 10 depend upon requirement. Therefore, petitioner is at liberty to make application in terms of Survey and Boundaries Act either in Form 8 or 10. If such an application is received from the petitioner by the second respondent, second respondent shall take steps to measure and determine the boundary of the petitioner's property within two months from the date of receipt of a copy of the application, if so required, with the assistance of the third respondent.
The Writ Petition is disposed of as above.
