JUDGMENT / ORDER

Learned advocate appearing for the applicant has invited this court's attention to the averments made on oath at para-3E at page-20 and sought permission to join respondent no. 2 by name.
Accordingly, leave for joining the respondent no. 2 by name is granted. The respondent no. 2 is present in the Court and therefore, learned APP Shri Kodekar makes a request for time for filing, if so advised, appropriate reply to this allegations.
At his request, matter is adjourned to 29.02.2012. If the respondent no.2 wants to file any reply, the same shall be filed before 29.02.2012 and in case, if no reply is filed by respondent no. 2 in his personal capacity, then, it may be presumed that he has got nothing to say so far as the averments made in the petition and the court may proceed further. S.O to 29.02.2012.
