THIS PETITION COMING ON FOR ORDERS THIS DAY, B.S.PATIL, J., MADE THE FOLLOWING:
O R D E R This writ petition is filed seeking a writ of habeas corpus to produce the detenue/N.Anuja, youngest daughter of the petitioner before this court.
2. The petitioner has made allegations against the third respondent/Suresh Babu that he had abducted the daughter of petitioner. It is alleged in the petition that she was kept in illegal detention. In view of the above, learned Addl. Government Advocate was directed to take notice and secure information. Pursuant to the direction issued, Yalahanka Police have produced Smt. N.Anuja and Sri Suresh Babu before this court. Both of them are present.
3. It is noticed that Smt.N.Anuja is aged about twenty six years and Sri Suresh Babu is aged about thirty one years. Both are qualified inasmuch as Smt.N.Anuja claims that she is a post-graduate in commerce, whereas Sri Suresh Babu submits that he has completed M.B.A. It is submitted by both of them that they have married by way of registered marriage on 24/11/2016.
4. Petitioner is also present before the court. She expresses her willingness to accept her daughter and son- in-law and desires that both of them visit her house and that there will be no difficulty for them to stay with them for sometime and to continue their relationship with her family though it was an inter-caste marriage. Smt. N.Anuja and her husband express some reservation to go over to the house of the petitioner apprehending that there would be disturbance at the instance of relatives and friends. They however, assured to the court that eventually they might call on the petitioner and other relatives to have normal relationship with the petitioner and the other family members. We may also place on record here that, father of respondent No.3/Suresh Babu, by name Krishnappa is present before the court. He also expresses that there will be no impediment for N.Anuja and his son Suresh Babu K., to stay along with him in his house.
5. In light of the above, nothing survives for consideration in this habeas corpus petition. Hence, placing on record the developments as aforesaid, this writ petition is disposed of.
